It is not known why William left Randolph County NC some time after 1810 and brought all his children and their families with him to Bibb County Alabama, except for the one son Samuel who remained in NC [per estates]. Of the various branches of the Smitherman family this is perhaps the most documented of all. It seems that you cannot pick up a court book or marriage book in Bibb Co. and not find information on the descendants of William SR.
In November 1822 sons Joseph Smitherman and Jesse Smitherman submitted the appraisal amount of all the goods and chattels of William Smitherman deceased. This amount was listed as four thousand eight hundred and fifty seven dollars eighty and one half cents. The estate sale was held 5 December 1822 at the late dwelling of the deceased. Final estate sale amounted to five thousand four hundred & ninety two dollars and seventy-seven cents.
In 1800 Randolph County, NC page 326 his family is listed as 1 male under 10, 1 male 26-45 [born 1755-1774], 2 females under 10, 1 female 10-16 and 1 female 16-26.
1810 he is still in Randolph Co., NC on page 182. His family is listed as 1 male 10-16, 1 male 16-26, 1 male over 45, 2 females under 10, 1 female 10-16, 1 female 16-26, and 1 female over 45.
William Smitherman Sr. departed this life in 1821/22 Bibb Co., Alabama. At the time of his death it was listed in administrative records that “the widow and relict of the said William Smitherman had departed this life before the decease of the said William Smitherman”. Nothing is known about who the wife/wives of William Smitherman Sr. were. There has been much speculation but no one has located any proof as to name. Some have even listed Anna as his wife. He did have a son William whose wife was named Anna, but there is no evidence to support him ever having been married to an Anna. Others have listed that the mother of his children was Grace Latham. There was a marriage in Randolph Co., NC between a William Smitherman and a Mrs. Gracey Latham. That marriage took place 1 January 1807, which is after most of his children were born. Bondsman on that was William Latham. If this is the same William then only his youngest child would have been by her.
According to the estate of Wiliam Smitherman Sr. and the later estate of his son Jesse Smitherman [died without legitimate heirs] he had the following children:
1. Catherine Smitherman. According to census records Catherine was born ca 1778 VA/NC. In the 1800 Randolph Co., NC Census she is listed as age 16-25 married with 2 daughters. In 1810 she is still listed in Randolph Co., NC and is listed as age 26-45. 1830 she is living in Bibb Co., Al. and is listed in the census as age 50-60. The last census she appears in she is listed as age 72 born Virginia. She married William Latham Sr. sometime before 1800 in North Carolina [census]. They moved with her father and siblings to Bibb Co., Al. Her husband William passed away 21 October 1821 in Bibb County, Alabama. Catherine died before 1864 according to her brother Jesse Smitherman's estate. At the time that her father’s estate was being settled in Bibb Co. her husband’s estate was also being settled. Catherine had 12 children. In 1864 at the time her brother Jesse’s final estate settlement was being made, only 3 of her children were listed as still living.
2. Samuel Smitherman. Born between 1784/1790 and died 1836 Troy, Montgomery County North Carolina. In 1810 NC Census he was listed as age 26-45. In the 1830 US Randolph Co., NC Census Samuel was listed as age 40-50. Per William Sr.’s estate his eldest son was Samuel who in 1822 was a non-resident of this state. According to Jesse Smitherman’s final estate settlement in 1864 Samuel had the following heirs who were all residents of North Carolina: Noah, Jesse, Polly, and Nancy. Many researchers have got this Samuel and his 1st cousin Samuel W. b. 1789 NC [son of Thomas Sr.] confused. Samuel Smitherman died around 1836 in North Carolina. His estate was settled in Surry Co., NC in 1836.
3. Margaret Smitherman. Born between 1784 and 1794. Margaret died before the 1850 census was taken. Margaret was married twice. She married 1st Willie R Goodwin on 25 October 1828 in Bibb Co., Al. This family was not listed in the 1830 US Bibb Co., AL. Census. She married 2nd Hardy J Davis on 8 November 1836 in Bibb Co., Alabama. Margaret had 3 children: Rebecca Ann Harriet Goodwin [by her 1sta marriage] who married John S Cox [son of Joseph W Cox & Nancy]. Bodecia Ann Davis who married Granderson Smitherman [son of Samuel W. b. 1789 NC], and Lavinia Catherine Davis who married James William Smitherman [son of Jesse b. 1807 NC]. Her brother Joseph Smitherman was appointed guardian of her minor children Bodecia Ann and Lavinia Catherine.
4. Elizabeth Susan Smitherman. Elizabeth was born ca 1785 NC and died after 1863. She married Benjamin Tucker. This family lived in Bibb Co., Al. In 1810 US Randolph Co., NC she is listed with her husband and was age 26-45. In 1830 US Bibb she is listed as age 40-50. 1840 US Bibb She is listed as age 50-60 as is Benjamin. In the 1850 US Bibb she is listed as age 65 born NC, and in 1860 she is listed as Susan age 72 born NC.
5. William James Smitherman . William was born ca 1787 NC, and died 14 November 1860 in Bibb Co., Al. According to the 1830 US Bibb Co., AL. Census he was listed as age 40-50. In the 1840 US Bibb Co he is listed as age 50-60 and in 1850 US Bibb Co., Al. Census he was listed as age 63. He has 2 estates filed in Bibb Co., Al. one under the name of William Smitherman and the other under James Smitherman both with the same heirs and widow. His wife was Anna [maiden name unknown]. After the death of William his widow Anna married Rev. Julius Webb in Bibb Co., Al.on 13 February 1862. According to a petition filed by Anna Webb late Anna Smitherman in Bibb Co., Al. on 20 May 1863 she listed that they were “married in Union County, Tennece about the year 1809 or 1810”. According to information sent to me by Kay Anderson “UNION COUNTY is one of Tennessee's later counties, being first authorized in 1850, however, the final organization of the county offices was not completed until 1854 so there is no way that they could have been married in what we know now as Union County, Tennessee.
6. Mary “Polly” Smitherman b. ca 1788 NC and died before 1864. She was not married in 1810 and was listed as age 10-16. Lawrence Latham signed a surety bond for ten thousand dollars on the estate of William Smitherman Sr., along with William Smitherman, Andrew Smitherman, and Benjamin Tucker. In the 1840 Mississippi census she was listed as age 40-50. It is assumed that she died in Mississippi, probably in Clarke Co. Polly was married to Lawrence Latham. According to her brother Jesse Smitherman’s final estate she had the following children who were all non residents of Alabama: Nancy, Sarah, Patsy, Betsy, William, Jesse, and James.
7. Sarah “Sally” Smitherman Sarah was born ca 1780 NC. In the 1830 US Bibb Co., AL. Census she is listed as age 40-50. In the 1840 US Bibb Co., Al. Census she is again listed as age 40-50. Sarah Smitherman had only had 1 child prior to her intermarriage to Edward Lawrence and that child was listed as Nancy Smitherman. It is assumed that she was indeed married twice but there is only proof of one marriage. This is per her estate and her son-in-law Branson Lawrence who was also her stepson was the administrator. Much has been published incorrectly about her first marriage and the number of children. There was only 1 child listed who was a Smitherman, in both her estate and her brother Jesse’s estate. She married Edward Lawrence on 16 February 1816 in Randolph Co., NC
8. Jesse Smitherman was born ca. 1790 NC and died after 1860 Bibb Co., Al. and before 1864. In 1830 US Bibb Co., Al. Census he is listed as age 40-50. 1840 US Bibb he is listed as age 40-50 and in 1850 he was listed as age 60. His widow was Phereby, maiden name unknown. Jesse died according to his will “without legitimate heirs”. In his will the first article lists: “At my death I wish to be buried in a Christian like manner at the graveyard on my premises where I now reside.” The exact location remains today unknown. In Jesse’s will he refers to his plantation, which he lists as consisting of about six hundred acres more or less. He left his entire estate that was to remain in tact, to his wife. He listed that if his wife married then his estate was to go to his “friend and nephew Samuel C. Tucker”. There were two of his slaves named Wade & Dise that after he & his wife’s death were to be set free. He appointed Enoch Morgan and Samuel C Tucker to act as their agents and to see that they were provided for in their old age. Jesse appointed James M Latham as the executor of his last will & testament. It was his estate that has helped to clear up a lot of incorrect assumptions and listed all the children and most of the grandchildren of William Smitherman Sr.
9. Joseph Smitherman was born ca. 1794 NC. Joseph married 1st to “unknown”. He married 2nd to Sarah Latham on 25 October 1827 in Bibb Co., Al. He had at least 6 children before his last marriage to Sarah [Martha b. 1815, Daniel b. 25 Nov. 1816, Grandison b. 3 Nov. 1818, Nancy b. 1820, Sinia b. 5 April 1824, and Mary Ann b. 25 June 1826] and 4 by his last wife Sarah Latham. His children by Sarah Latham: Joseph B.[listed in 1850 Rutherford Co., TN as James age 21 in the household of his half sister Nancy Smitherman Smotherman and her husband Wm. M. Joseph’s children were:James G, Issac Newton, Nancy Elizabeth and Julia], Sarah [who married Andrew Tucker], John D. and Thomas J. [this is Judge Thomas J Smitherman, attorney].
10. Andrew Smitherman was born ca. 1800 NC, died 1867 Bibb Co., Al. In 1810 he was listed at home age 10-16. In 1830 US Bibb age 30-40, 1840 listed as 30-40. In 1850 listed as age 50 and in 1860 was listed as age 60. His tombstone, which existed until some years ago listed that he died in 1867 at age 67 years 4 months. Andrew has 2 estates the first in located in Bibb Co., Al. and was filed in 1867. His second estate was probated in 1911 in Chilton Co., Al. Andrew was married 3 times. He married 1st Ruthy Wilson on 5 Nov. 1822 Bibb Co., Al. daughter of Rev. War soldier John Wilson. He married 2nd Margaret Wilson on 7 January 1836 in Bibb Co., Al. who was a sister of Ruthy. Andrew married 3rd Lucinda Bishop on 25 February 1862 in Bibb Co., Al. Andrew and Lucinda did not have any children.
11. Massina O Smitherman or “Sinah” as she was called was born ca. 1802 NC and died August 1874 in Bibb Co., Al. Her estate was settled in Bibb Co., Al. In 1810 US Randolph Co., NC listed as under 10. 1830 US Bibb Co., Al. Census lists her age as 20-30. In 1850 she is back in Bibb Co., Al. and is listed as Mathessa O age 45 b. NC. In the 1860 US Bibb she is listed as age 58, and in 1870 she is listed as age 66. She married Eliah Jones on 7 January 1826 in Bibb Co., Al. She and Eliah went to Georgia sometime after the 1830 census was taken as indicated by where their children were born. In her estate she is listed as Sinah Jones. She had the following children listed in her estate: 1.Harriett Ellen Jones wife of Isaiah Belvin, 2. Margaret Jones, wife of C. C. Latham, 3. D Bailor Jones [married Nancy Ann Smitherman], Susan A E Jones married “unknown” Johnson [at the time of her mothers death her heirs resided in Twiggs Co., Ga. In Twiggsville.] According to early census records there is another son. He must have died without issue prior to the death of Massina.
12. Nancy Rebecca Smitherman was born ca. 1808 NC and died 5 April 1855 in Cherokee County, Texas. She married Alfred Atchison on 31 March 1825 in Bibb County, Alabama. Her husband is listed as both Alfred Atkinson and Alfred Atchison in various records. In 1830 US Bibb Co., Al. Census we find Alfred Atkinson with 10001 [1male under 5, 1 male 20-30] – 20001 [2 females under 5, 1 female 20-30].

The will of Branson Lawrence was filed for Probate on 5 June 1871 in Chilton Co. AL. Nancy, the widow, was shown as a survivor. In filing the Will for Probate on 5 June 1871 and his petition for approval to be named as executor, N. Z. Lawrence (a son-in-law), listed the next of kin as:
Nancy S. Lawrence (presumably the widow); [2] Mary A. Lawrence; [3] Margaret P. Lawrence; [4] Serena A. Lawrence; [5] Elizabeth D. Pickett, wife of Michael Pickett, a resident of Bibb Co., AL; [6] Rebecca E. Smitherman, wife of Thomas Smitherman, a resident of Logansport, Shelby, TX; and [7] Sarah E. Lawrence, wife of the petitioner, who reside in this county (that part of Baker later became Chilton Co.)--all of whom are over the age of 21. An inventory of certain assets and debts of the estate of Branson Lawrence, dec'd, was filed with the Court on 4 Sept 1871. Most of the goods and chattels shown consisted of livestock.
It is thought that James J. Lawrence was also a child of Branson Lawrence. He is not mentioned in the list of heirs, but possibly since he would have been the only son, he received his portion when he became of age to marry.

Notes for BENNETT M. JAMES ATCHISON:
The 1860 Census of Bibb Co. Alabama lists James??? Atchison, age 22, born in AL, living next door to James and Martha Nix. James' wife Margaret is listed as age 22, born in AL. Their children are Columbus, age 2, and Mary, age 2/12, both born in AL.
My mother-in-law, Adelle Atchison Wright, remembered her family talking about Jack Atchison and she had assumed that was her father's grandfather's name. Her father's name was Homer B. Atchison and his father's name was Columbus Filmore Atchison. While looking for this name in the 1860 census I found his father and mother in Bibb Co. AL. Their names were James and Margaret Atchison, both are born about 1839. These names do not fit into any of the Atchison offspring in the 1850 census by ages. Also we could not find marriage records except for a Bennett Atchison and Margaret Gardner married in 1859. His father was Jackson Atchison and he was a member of Mulberry Baptist Church. The only thing I could figure was that James and Bennett are the same person, because James or Bennett (whichever) disappears during the Civil War and Margaret is left with 3 children in the 1870 census: Mary, Columbus and Bennett Monroe. Possibly he died during the war and she named the last child after him. She must have lived near her father-in-law and that is where my mother-in-law got the name Jack. Margaret has died by the 1880 census and the children must have been on their own at a young age. Bennett Monroe's descendants spell their name as Atcheson.
Another interesting point is that my mother-in-law's grandmother's sister was married to one of Yancy Dyer Atchison's sons, William Yancy Atchison so she knew him as Uncle Bill and always assumed that he was a brother to her grandfather but that does not seem to be true.
I guess that is enough to totally confuse you but we have puzzled over it quite awhile.

Information 1: I have not totally proved that this is the Atchison that is the father of Columbus Filmore Atchison but several facts seem to fit together. The reason I am not sure about this connection is that this person is named Bennet in some place and James in other
Information 2: Columbus Filmore Atchison's death certificate has Bennett Atchison as his father.
Information 3: I think the children were then raised by others and there is the reason that Bennett changed the spelling of his name. Descendant of Columbus Atchison seem to have heard very little about the family history.
Information 4: Jack Atchison and Margaret Atchison's names are found in the records of Mulberry church after the war. He had lost 2 sons and she had lost her husband in the war. She is found in the 1870 Census of Bibb Co. AL but apparently is deceased soon after that.
Information 5: Some of the descendants of Columbus Atchison remember the name Jack in this family. I think that Jack would be the father-in-law of Margaret Gardner Atchison. After the civil war when James had died she apparently lived with her father-in-law.

Information 1: Their house was one of the finest in Bibb Co. Isaac bought more land in 1858 to total almost 1,000 acres, mainly located in Township 21N, Range 11E, Sections 4, 5 and 32.
Information 2: Due to the hard times following the Civil War, Isaac's acreage dwindled to 240 acres by the time of Mary Ann's death in 1895.
Information 3: Isaac inherited one quarter section of land (Township22N, Range 11 E, Section 22), one slave named Louisa, livestock, and household goods. With this inheritance and the slaves Mary Ann had inherited from her father, they built a 2 story house.
Information 4: Isaac suffered a stroke while preaching a revival.
Obituary 1: Obituary in "The Alabama Baptist Newspaper" reads: "Rev. I.M. Hicks-The messenger death called Brother Hicks from labor to rest July 20th 1886. He was born August 15th 1815. Bro Hicks was licensed to preach July 1856, and was ordained for full work

267. "Scrapbook kept by Gladys Barnes," Mrs. Mary Edwards Hicks, age 87, (born January 9, 1875). Born and reared in the rural section of Bibb County, near Lawley, Alabama, the daughter of the late Frances Belvin Edwards, and the late Bennett S. Edwards, died June 8, 1962 (Friday) in the Chilton County Hospital, Clanton, Alabama at approximately 12: 50 A.M. Funeral services at the Rehobeth Baptist Church, Lawley, Alabama 3 P.M. June 9th. The Rev. J. R. Robinson of Notasulga, Alabama was incharge of services and was assisted by the Rev. Eddie Ruddick of Huntsville, Rev. Grady Williams of Clanton, Alabama and the Rev. Lloyd Jones of Stanton, Alabama. Pallbearers wer Archie McKinney, William Lee Gay, Millard Reynolds, Melvin Carter, C.C. Gay, Jr. Manley and Hershel Parnell. Incharge of thehuge floral arrangements were: Mrs. John T.O'Neal, assisted by Ms. Pauline Carroll, Mrs. William Ruddick. Mrs. Hicks, early in life joined Tabernacle Methodist Church. She married I. U. W. Hicks, son ot the late Rev. I.M. Hicks of Lawley, Alabama when 17 years of age and soon afterwards joining the Rehobeth Baptist Church accepting the faith of her husband and remained a member of that church until her death. She was a charter member of the Adult Sunday School Class of this church and the eldest member of the Plantersville, Alabama Eastern Star Chapter No.309. Mrs. Hicks was deeply loved and respected by all who knew her. She shared with those less fortunate; lending a helping hand at all times with those in need. She was an excellent neighbor, an affectionate and loving wife and mother-never complaining. Mrs. Hicks loved life and people. Greeted visitors to the last at her home with a smile and asked them to come back to see her. Mrs. Hicks was critically ill from Thursday May 31st remaining in the home until Monday night, June 4th, when she was removed by Martin's Ambulance to the Chilton County Hospital, Clanton, Ala. Friends and relatives gathered from near and far to attend the last rites of their loved one.
